The agreement

Terms & conditions

The terms on which CameeO Love, LLC sells original artwork.

These terms are a starting point drafted to match how this site works. They are not legal advice and should be reviewed by an attorney before launch.

1. Who you are dealing with

This site is operated by CameeO Love, LLC (Detroit, Michigan, United States). Using the site means accepting these terms.

2. The artwork

Unless a listing says otherwise, every piece offered is an original, one-of-one work made by hand by Patricia Brackett. Because each is unique, when it is sold it is gone — sold work remains visible in the archive but cannot be ordered.

Colours vary between screens, and photography cannot fully convey a surface with impasto, metallic passages or raised elements. Minor variation between the photograph and the piece in the room is the nature of the medium, not a defect.

3. Prices and payment

  • All prices are in US dollars.
  • Shipping and any applicable sales tax are calculated at checkout and shown before you pay.
  • Payment is taken by Stripe. By paying you also accept Stripe’s terms.
  • A sale is only formed when payment is confirmed. Adding a piece to your cart reserves nothing.
  • If a piece is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than fulfil it.

4. Reservations on originals

When you begin checkout, the piece is held for you for a short period so that nobody else can buy it while you are paying. If you do not complete payment within that window, the hold lapses and the piece becomes available again.

5. Shipping and risk

Delivery terms are set out in Shipping & Returns, which forms part of these terms. Risk in the work passes to you on delivery, or on collection in the case of local pickup. Shipments are insured in transit.

6. Returns

Returns are handled as described in Shipping & Returns.

7. Copyright — please read this one

Buying a painting buys the physical object. It does not buy the copyright. Patricia Brackett retains copyright and all reproduction rights in every work, including work that has been sold.

As the owner of the physical piece you may:

  • Display it in your home or premises.
  • Photograph it for your own personal, non-commercial use.
  • Resell the physical piece.

You may not, without written permission:

  • Reproduce it as prints, cards, textiles, merchandise or any other product.
  • Use it commercially, in advertising, or as part of a brand.
  • Create derivative works from it.
  • Use it to train a machine-learning or generative AI system.

All images and text on this site are likewise the property of CameeO Love, LLC and Patricia Brackett and may not be reproduced without written permission.

8. Commissions

Submitting a commission enquiry does not create a contract and does not guarantee acceptance. Scope, price, timeline and terms are agreed separately in writing before any work begins. Copyright in a commissioned work remains with the artist unless a written agreement says otherwise.

9. Availability of the site

We aim to keep the site available and accurate but do not guarantee it will be uninterrupted or error-free. Listings may be corrected, changed or withdrawn at any time.

10. Limitation of liability

To the fullest extent permitted by law, CameeO Love, LLC’s liability arising from an order is limited to the amount you paid for it. Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Governing law

These terms are governed by the laws of the State of Michigan, United States.

12. Changes

These terms may be updated. The version in force is the one published here at the time of your order.
